The Illustrator provides custom illustration and design services, including, but not limited to: book cover illustrations, character art, chapter headers, author pfp’s, edge designs, maps, endpapers, merch design and related visual materials, as outlined in the agreed Project Scope. The scope will define the deliverables, timeline, and any additional specifications for the project.
USE OF ARTIFICIAL INTELLIGENCE (AI)
The Illustrator confirms that no AI tools or generative software will be used; all work will be hand-drawn, digitally or traditionally. The Client agrees not to use any part of the artwork, including drafts or final files, with AI or machine learning systems.
GENERAL PROCESS
Prior to delivering any final or polished artwork, a preliminary draft will be provided for review. Major changes after the sketching stage (such as alterations to poses, costumes, or composition) may incur an additional fee, as they often require restarting the artwork. After Illustrator and Client has discussed the sketch(es), the work on the polished and colored file(s) begin.
DELIVERABLES
Deliverables include high-res PNG, JPG, and press-ready PDF files unless otherwise agreed. Files are sent only after full payment; previews are provided beforehand. Source files (PSD, AI, Procreate, etc.) are not included unless agreed in writing and may incur an extra fee.
REVISIONS
The Client is entitled to three revisions: one during the sketch phase and two on the polished files. Revisions must stay within the original project scope. Additional changes or revisions beyond this will incur a $20 fee per round.
DEADLINES
Standard turnaround is 10–14 business days from the project start date. Timelines may change due to project scope, revisions, or delays. Rush requests must be discussed in advance and may incur an extra fee.
CLIENT COMMUNICATION AND CONTINUITY
Timely communication is essential to keep projects on schedule. If a client becomes unresponsive for more than 14 days without prior notice, the project may be paused or considered complete based on the last approved draft or milestone. Outstanding balances for work already completed remain due, and any unapproved work may be withheld until communication resumes.
ILLUSTRATOR’S RESPONSIBILITIES
The Illustrator will meet deadlines, deliver final files as agreed, and use no copyrighted material without permission. If a deadline is missed due to the Illustrator’s fault, the Client may request a revised timeline or, at the Illustrator’s discretion, a full refund. Final files are delivered within 72 hours of full payment; any delays will be addressed promptly.
FEES
The Client will pay the total project fee via Wise (bank transfer, card, apple pay and google pay payment options, no registration needed). A 50% non-refundable deposit is required to secure the project, due at least two weeks before the start date. The remaining 50% is due upon completion, before final files are delivered. Work begins only after the deposit is received.
EXPENSES
Any additional expenses (e.g., special materials, fonts, third-party assets, printing tests, or external services) must be discussed and approved by the Client in advance.
OWNERSHIP
The Illustrator retains ownership of all original artwork, including sketches, drafts, and final illustrations, until full payment has been received.
USAGE RIGHTS
Upon full payment, the Client receives exclusive, worldwide, perpetual usage rights as defined in the Project Scope. Promotional rights allow marketing use, while commercial rights cover reproduction in products for sale. The Illustrator retains the right to showcase the artwork and preliminary work in their portfolio, website, and social media once officially published.
CONFIDENTIALITY
Both parties agree to keep confidential any proprietary or sensitive information shared during the project and not to disclose such information to third parties without prior consent.
TERMINATION
Either party may terminate this Agreement with written notice. In the event of termination, the Client agrees to compensate the Illustrator for all work completed up to the termination date. If the cancellation occurs for reasons outside of the Illustrator’s control, the initial deposit is non-refundable.
GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of Hungary.
INVOICING AND DATA PROTECTION
The Client’s name and physical address are required for invoicing. An invoice will be issued upon the deposit request, and on the date of project completion. The Illustrator complies with GDPR regulations. Personal data provided by the Client will be used solely for project and invoicing purposes and handled confidentially. The invoice covers the full scope of the project and includes all items and services agreed upon.
By submitting the deposit, Client acknowledges that they have read and agree to these Terms of Service, which acts as a contract between Melinda Magyar (“Illustrator”), and Client (“Client”).
